This can be an exciting time, but also a busy and somewhat stressful one.A real estate lawyer's job is to make sure that you can concentrate on the good things, while we focus on dealing with the stressful ones.

Residential Purchase and Sales

My words;

Your real estate lawyer's job in a transaction is to make sure that your interests are protected, and to facilitate the sale or purchase. While it is common practice in Alberta to sign a residential contract before speaking to a lawyer, it is your lawyer's job to make sure that you understand what that contract says in it's entirety. 

​

There are obligations and liabilities associated with a real estate transaction, and pitfalls that your lawyer will watch out for. Please never hesitate to ask your lawyer for clarification on what a clause or term means in your contract. Lawyers deal with things like encumbrances, RPRs, and mortgage instructions on a daily basis, but we understand that most people have never heard these terms before and it is our duty to make sure that you understand them.

Once the contract has been reviewed your lawyer will get to work gathering the necessary documentation and creating the paperwork you will need to fill out in order to finalize the deal. We will liaise with the other people involved in your transaction, such as your mortgage broker, real estate agent, or condo board, to get everything ready.

Some real estate transactions may have hiccups, such is the way of things. It is how your lawyer deals with those hiccups that will make all the difference in your experience.

Commercial Real Estate 

​

Like in a residential sale, a commercial real estate lawyer's main job is to protect your interests and make sure you are aware of the obligations and liabilites that are involved with the transacction. Unlike residential real estate, a lawyer is often consulted before the contract is signed in order to assist with negotiations and to perform due diligence.

Mortgage Refinancing

Their words; Mortgage refinancing is a process of replacing the original mortgage on your property with a new mortgage, generally with different terms than the original mortgage.

 

In most cases, refinancing your mortgage will require finding a new lender who will pay off your current mortgage.

 

Mortgage refinancing can be beneficial in some situations but disadvantageous in other situations. Most property owners refinance their mortgage to improve the terms of their current mortgage agreement.

Please note that these prices are subject to additional fees depending on the complexity of the matter. My flat fees include 1 hour of dispute resolution between the parties. Further complications are charged by an hourly rate.

These rates do not include dispursements, such as court filing fees,
+ process server fees (to serve documents or file materials with the court),
+ courier charges,
+ travel expenses to attend settlement meetings off-site, including parking and/or mileage,
+ fees charged by third parties retained to perform services on your behalf (e.g. pension valuations, real estate appraisals, business valuations, income tax experts, etc.), and
+ any other charges incurred by this firm on your behalf.
